LLC and its affiliates and related entities (collectively, “Company”) is/are
committed to protecting the privacy of certain data that is collected from you
and that you submit when you access this web site or web sites under our
operation and control (collectively, the “Site”). We recognize the sensitive
nature of much of the information with which we are entrusted on a daily basis,
and we are committed to the high standards of privacy and security. The nature
of our business requires that we gather information that is of a personal
nature and that you wish to keep protected. This Privacy Policy (“Policy”) is
intended to familiarize you with our policies for the gathering, use,
maintenance and protection of personal information on the Site. Please note
that this Policy does not apply to you use and activity on other sites, such as
those website and other applications owned and operated by Dunkin’ Brands (including
Dunkin’ Donuts).
More specifically, this Policy
summarizes how the Company handles the personal and other information users of
the Site provide while accessing and using the Site. Please review this Policy
carefully. The Company reserves the right to change its Policy at any time without
advance notice, in which event the Site will contain a notice of the change.
Changes will be effective immediately upon posting to the Site. By accessing
the Site, you are indicating your agreement to the Company’s Policy. If you

information provided below.
Information Collected. As you are probably aware, we may collect
information from a variety of sources. We collect and use this information in
order to carry out our business functions and provide the highest quality of
service. In general, the Company may
compile statistical information concerning the usage of the Site. This
information allows the Company to monitor its utilization and continuously
improve its quality. Examples of this information would include, but not be
limited to, the number of visitors to the Site, or to sections or pages within
the Site, patterns of traffic flowing through the Site, length of time spent on
the Site, or in sections or pages of the Site, the other sites that refer
visitors to the Site, the pages of the Site that visitors frequently use as
entry and exit points, utilization of the browser and operating systems and
versions used by visitors to the Site.
In order to compile this
information, the Company may collect and store your IP address, your operating
system version, your browser version, the pages you visit within the Site, the
length of time you spend on pages within the Site, the site from which you
linked to ours, search terms you used in search engines which resulted in you linking
to the Site, etc. While all of this information can be associated with the IP
address your computer had while you visited the Site, it will not be associated
with you as an individual, or associated with any other information you may
submit through the Site, or that Company may store about you for any other
purposes.
Additionally, if you decide to
provide your personal information, the types of personal information we may
collect about you through the Site includes: (i) your contact information, such
as name, address, e-mail address, phone numbers; (ii) account set-up; and (iii)
employment history information if you seek employment with us which might
include your work history.
The Company may use web site
“cookies” in the process of compiling the statistical information mentioned
above and to tailor certain pages of the Site for your browsing convenience. A
cookie file can contain information such as the URL you came from, your
computer's IP address and domain type (e.g., .com or .org, etc.), your browser
type, the country, state and telephone area code where your server is located,
the pages of our site that were viewed during a visit, and any search terms
that you entered on our site. This information generally is used for internal
purposes, and we do not link your URL or IP address to any personal information
unless you have logged into our Site with an established account login and
password. You have the option of setting
your browser to reject cookies, but our Site may not function correctly if you
do. Refer to the Help feature of your browser for information on disabling
cookies.
The Site is not directed to
children. The Company does not knowingly collect any personal information from
children. If you are concerned about your child’s use of the Site, you may use
web-filtering technology to supervise or limit access to the Site.
Use of Information. In
general, we will use the information we collect about you only for the purpose
it was collected, as otherwise provided in this Policy, and as permitted or
required by law. For example, we might use your information to enhance our
Site, or to communicate with you about the Site or our products and services,
special offers, or in connection with your application for employment.
Disclosure of Information. In general, we will not disclose your
information for any purposes other than those in conjunction with the business
activities requested of us unless otherwise permitted or required by law or by
this Policy. In the course of our normal business activities, we may disclose
collected information to both affiliates and non-affiliated entities, as we
deem necessary. For example, and without limitation, the Company may need to
use or disclose this information with its third party vendors to manage its
website, respond to subpoenas, defend litigation, enhance its services, manage
its franchise obligations, and protect the Company’s legal rights. We endeavor
to choose affiliates and non-affiliates with similar standards to ours
regarding the protection of personal information.
In no case will the Company sell
or license personal information to third parties, except as required or
permitted by law. For example, we may share personal information in connection
with certain business transactions, such as the acquisition of all or
substantially all of the Company’s assets. In such cases, we will take
appropriate steps under the circumstances and to the extent possible to ensure
that the recipient agrees to provide privacy protections substantially similar
to those established by this Policy.
Safeguarding of
Information. No system for safeguarding personal or other information is
100% secure. However, we take a number of steps to safeguard the security of
personal information obtained through the Site. For example, we use Secure
Socket Layer (SSL) data encryption when certain personal data is transmitted
over the Internet to our Site. We have installed layered firewalls and other
security technologies to help prevent unauthorized access to our systems. Our
data centers are maintained in a secure environment with appropriate security
measures. Our employees are trained to understand the importance of
confidentiality and are required to adhere to our privacy policies and
procedures. Employees who violate these policies and procedures are subject to
disciplinary action. We employ numerous practices to protect against the
disclosure of information for purposes unrelated to the performance of our
business functions or to individuals other than those who must use it in the
course of their work activities. These practices include the use of password
protection of computer files, e-mail and voice-mail, video surveillance, and
other physical, electronic, and procedural safeguards.
Information for Job Applicants. The Site permits individuals to submit
applications for employment with us which requires the collection of
information from you on the Employment page of this Site (the “Employment
Page”). The Employment Page is designed
to support the Company’s recruitment efforts, and is not intended for
distribution or use in any jurisdiction or country where such distribution or
use would be contrary to local law or regulation. Personal information
collected on the Employment Page is governed by this Policy.
The Employment Page
does not extend binding offers or terms or conditions of employment. Any
employment offer that may result from your submitting information in response
to a job opening listed on this Employment Page is in accordance with the
specific terms of that offer and is not based in any way on the description of
the job on this Employment Page. Except as otherwise prohibited by law, nothing
on this Employment Page or the Site shall be construed as a contract of
employment or as a guarantee of continued employment or employment for any
specific duration. Employment with the Company is "at will" and that
generally cannot be modified by an employee or representative of the Company.
This means if you are hired, either you or the Company can separate your
employment at any time without notice or cause.

Dunkin' Donuts franchises throughout Southern Maryland and Northern Virginia.

that, by applying through the Employment Page for a particular position(s),
your application also may be considered for other positions or other positions
may be recommended to you based on your qualifications.
By using and
entering information on the Employment Page, you indicate your acceptance of
our collection, retention, use, transfer and disclosure of the information
relating to your usage and information entered as described in the Policy. This
includes the transfer of personal information about you to countries outside
your home country, including countries where data protection laws may differ
from those of your home country. The Company maintains safeguards designed
to protect your personal information provided on the Site, however, the
statements in the Policy concerning the treatment of your information obtained
through the Site may not apply with respect to information already in the
Company's possession, such as information obtained by the Company in connection
with your current or former employment with the Company, or information that is
publicly available to the Company.

submit on the Employment Page to apply or search for a position at the Company,

We do not require,
but you may also voluntarily choose to provide, other relevant information as
part of your application. We would prefer that you avoid submitting the
following sensitive information, except where such information is legally
required, or needed for us to comply with our legal obligations and internal
policies relating to diversity and anti-discrimination: medical or health
conditions, family medical history, genetic information, sexual orientation,
race, ethnic origin, religious or philosophical beliefs, marital status, trade
union membership, sex life, creed, nationality, national origin, and/or
color.
Any information you
submit must be true, complete, not misleading and you must have the lawful
right to provide it. If not, this may lead to a rejection of your application
during the application process or disciplinary action including immediate
dismissal if you have been employed. If you intend to provide us with details
of a reference or any other third party as part of your application, it is your
responsibility to obtain consent from that third party prior to passing the
personal information to us.
The provision of
personal information, including on the Employment Page, is voluntary. Please
note however that the failure to provide sufficient information may result in
the Company being unable to consider you for employment, promotion, transfer,
or relocation.
The information that
you submit in your application on the Employment Page may be accessed,
collected, used, transferred and disclosed by employees, consultants and/or
service providers of the Company for our recruitment functions and for related
management and planning purposes, including, as permitted by local law,
to:
- process your application;
- assess your capabilities and qualifications for a job;
- provide to you any services available on the Employment Page from
time to time;
- communicate with you;
- comply with any applicable law or regulation;
- compile internal reports, including diversity and distribution
metrics;
- monitor and record services whether provided by us or a third
party; and
- conduct background checks if you are offered a job.
The information you
provide in connection with an application on the Employment Page will be added
to the Company’s candidate database and will be used for the purposes of
considering whether your profile is suitable for other job vacancies at the
Company. This information will be reviewed by Company employees or agents who have a business need to access such
personal information and may include recruiters, human resources personnel,
technical services personnel and managers or their designees. If we elect to
make you an offer, personal information you submit may be incorporated into our
human resources system and used to manage the new-hire process. If you become
an employee, any personal information that you submit may become part of your
employment file and may be used for other employment/work-related purposes as
permitted by local law. Such information also may be shared with selected
service providers or consultants acting on our behalf, such as third parties
assisting the Company with the operation of the Employment Page and the storage
of information collected on the Employment Page. These third parties will be
required to use appropriate measures to protect the confidentiality and security
of personal information which are no less protective that those set out in this

The Company also may disclose information
obtained from the Employment Page about you in order to: (1) protect
the legal rights, privacy, safety or property of the Company or its employees,

security of visitors to our Site or other properties; (3) protect against
fraud or other illegal activity or for risk management purposes; (4) respond
to inquiries or requests from public or legal authorities, including to meet
national security or law enforcement requirements; (5) permit the Company to pursue available remedies or limit
the damages that we may sustain; (6) enforce the Site’s Terms of Service; (7) respond to an emergency;
(8) comply with the law or legal process; (9) effect a license, sale
or transfer of all or a portion of the business or assets (including in
connection with any bankruptcy or similar proceedings); or (10) manage or arrange
for acquisitions, mergers and re-organizations.
We are required to
temporarily retain certain information relating to candidates applying for
jobs. If there is no activity in relation to information submitted in
connection with a job application, the Company may remove it from its database,
subject to our data retention
obligations and policies and any applicable legal or regulatory obligations or
for the period of time permitted by local laws, for the purpose of considering
whether your skills are suitable for other opportunities. Note that we may delete personal information about
you at any time without any reason. Therefore, please retain your own copy of
the personal information provided to us.
Applicable law. This Policy is governed by the internal
substantive laws of Massachusetts, without regard to its conflict of laws
principles. Jurisdiction for any claims arising under or out of this Privacy
Policy shall lie exclusively with the state and federal courts within Massachusetts.
If any provision of this Policy is found to be invalid by a court having
competent jurisdiction, the invalidity of such provision shall not affect the
validity of the remaining provisions of this Policy, which shall remain in full
force and effect.
